Everatt’s LLP (“Everatt’s”) fees on all other types of work is mainly by reference to the time spent by the fee earner dealing with the transaction or case; the time charged being all time spent on the client's affairs. This will include attendances upon the client and perhaps others, any time spent travelling; considering, preparing and working on papers and correspondence; making and receiving telephone calls.

Each solicitor and paralegal's time is charged at an hourly rate which reflects overhead costs. Letters (including e-mails & faxes) sent out by the firm are charged at 6 minutes a page, telephone calls are charged by 6 minute units and consideration of letters (including e-mails & faxes) received at 3 minutes per page.

The current hourly rates for all fee earners are set out below. These rates do not include VAT, which will be added when an invoice is prepared. At present VAT is 20%.

Where the instructions of the client require work to be done on an urgent basis and interviews or other work to be carried out outside Everatt's normal office hours, Everatt's reserve the right to increase the level of hourly rate.

The hourly rates set out above are normally reviewed annually to take effect from the 1st January and take account of changes in salary and other overhead costs. Details of any revision of rates occurring during the continuance of a case or transaction will normally be notified to the client but can also be supplied to a client on request. These rates may not be appropriate in case of exceptional complexity or urgency. Where it becomes apparent that such circumstances exist, Everatt's reserve the right to terminate the retainer unless revised rates are agreed in substitution.

Disbursements include payments made by Everatt's on behalf of the client. Examples of such items are Court fees, fees for medical reports, search fees, Land or Probate Registry fees, etc. Everatt's have no obligation to effect such payments, unless the client has provided funds for that purpose. We shall require such a payment in advance of search fees and other disbursements. We reserve the right to make a charge for travel, office expenses to include items such as facsimile transmissions (sent and received), postage, photocopying, archiving and other petty disbursements. VAT is payable on office expenses and certain disbursements.

Fees are payable whether or not a case is successfully concluded, or a transaction completed. If any case or transaction does not proceed to completion for any reason during the period in which Everatt's are instructed, then Everatt's shall be entitled to charge for work done on the basis set out above. If a matter does complete, then fees will be deducted from completion monies and will be shown as deducted on the completion statement.

We will give you estimates of our likely charges and expenses as the matter progresses and at least every six months. Our estimates are not intended to be fixed or binding and are intended to be a guide only; other factors might mean that the estimate needs to be varied from time to time. We will inform you if any unforeseen additional work becomes necessary (for example, due to unexpected difficulties or if your requirements or the circumstances significantly change during the course of the matter). Such estimates will normally be sent to you at the inception of the matter and which estimates will be revised should it become necessary as the matter/transaction proceeds.
